Privacy policy

This policy explains which personal data Blackout Colors processes when you use blackoutcolors.com, what it is used for, who it is shared with and how you can exercise your rights. It is governed by Argentina's Personal Data Protection Law 25,326 and its complementary regulations.

1. Who is responsible for your data

Blackout Colors is a digital agency for SMEs based in the Autonomous City of Buenos Aires, Argentina, working remotely with companies in Argentina and around the world. It is the controller of the personal data collected through this website.

2. What data we process

The website has no forms of its own, user accounts or newsletter, and it does not store what you enter on its own servers. Personal data reaches us through these channels:

Booking the free diagnostic

The contact page includes a Cal.com calendar to book the 30-minute diagnostic. When you book, Cal.com receives and passes on to us:

  • your name and email address;
  • the date and time you choose;
  • your answers to the fields of the booking form (for example, information about your company or the reason for the call, depending on the fields the form shows at the time);
  • if you arrived from a campaign, the visit's source parameters (utm_source, utm_medium, utm_campaign, utm_content, utm_term and the Google Ads and Meta Ads click identifiers), which the website adds to the calendar link.

Contact by WhatsApp or email

The website's WhatsApp button does not send messages to our servers: it opens WhatsApp with a pre-written message that you can edit before sending. If you write to us on WhatsApp or by email, we receive your phone number or email address, your profile name and the content of your messages, including any company information you choose to share.

Technical and browsing data

When you browse the website, the measurement tools described in the Cookie policy record:

  • pages visited, landing page and referring site;
  • device type, browser, language, screen resolution and approximate location derived from the IP address;
  • interactions with the website: clicks on contact buttons (with their text), FAQ questions opened, use of the WhatsApp button and confirmed bookings;
  • identifiers stored in cookies or in browser storage.

We do not ask for sensitive data (for example, health, ethnic origin or political opinions). Please do not include it in your messages.

We do not sell personal data or use it for purposes that are different from or incompatible with those listed.

4. Grounds for processing

We process the data you send us (through Cal.com, WhatsApp or email) because you contact us and we need it to reply, schedule the diagnostic or move forward with a proposal, that is, within a pre-contractual or contractual relationship that you initiate.

Measurement and advertising rely on your consent. The website currently does not show a cookie consent notice and these tools are activated as you browse: the Cookie policy explains how to disable or block them.

5. Who we share data with

We use providers that process data on our behalf or as part of their own service. Each has its own privacy policy.

Some pages show images and icons served by third parties (Unsplash, Simple Icons, Iconify and Google's icon service). When they load, your browser sends them technical data such as your IP address and browser type.

We may also disclose data when a competent authority requires it in accordance with the law.

6. International transfers

Google, Meta, Cal.com and Cloudflare may process information on servers located outside Argentina, including in countries that Argentina's Agency for Access to Public Information (AAIP) does not consider to provide an adequate level of protection, such as the United States. These providers apply their own data processing terms, which you can review on their websites.

7. How long we keep it

  • Inquiries and bookings that do not move forward: as long as needed to reply and follow up on the inquiry.
  • Clients: for the duration of the business relationship and, afterwards, as long as required by legal, accounting or tax obligations, or as needed to handle possible claims.
  • Measurement data: according to the periods configured in each tool. The duration of each cookie is listed in the Cookie policy.

When data is no longer needed for the purpose for which it was collected, we delete or de-identify it.

8. How we protect it

  • The website always runs over HTTPS and applies security headers (HSTS and a content security policy).
  • It is a static website: it has no database of its own and does not store what you write on our servers.
  • Cloudflare's network filters automated and abusive traffic before it reaches the website.
  • We choose established providers for scheduling, messaging and measurement, and we limit what is shared with them to what each purpose requires.

No system is completely infallible. If we detect an incident affecting your data, we will act to contain it and inform you when appropriate.

9. Your rights and how to exercise them

As the data subject you can:

  • access the data we hold about you, free of charge and at intervals of no less than six months, unless you show a legitimate interest in doing so sooner;
  • ask for it to be rectified, updated or, where applicable, deleted;
  • withdraw your consent to measurement and advertising;
  • ask us not to send you commercial communications and to remove you from any contact list.

To exercise them, write to contact@blackoutcolors.com stating your request. We may ask for information to verify your identity. We answer access requests within 10 calendar days and rectification, update or deletion requests within 5 business days, in line with the periods set by Law 25,326.

The Agency for Access to Public Information (AAIP), as the supervisory authority under Law No. 25,326, has the power to handle complaints and claims filed by anyone whose rights are affected by non-compliance with the personal data protection regulations in force.

10. Minors

The website is aimed at companies, professionals and adults interested in our services. It is not intended for anyone under 18 and we do not knowingly collect their data. If you are a parent or guardian and believe a minor has sent us data, write to us and we will delete it.

12. Changes to this policy

We may update this policy when the website's tools, our processing or the regulations change. The version in force is always the one published on this page, with its last updated date.
